Theresa is a Senior Associate in our dispute resolution department, specializing in commercial litigation including insolvency practice, and contentious and non-contentious probate. 

The following are key highlights of Theresa’s experiences:

• Commercial Litigation & Arbitration: handling all stages of civil litigation including drafting of pleadings, handling interim case management, trial preparation, appeal proceedings and taxation proceedings, attending to all incidental correspondences and negotiations; advising on the pursuing / opposition of a wide array of interlocutory applications including joinder, striking out, Mareva injunctions, proprietary injunctions, specific discovery, security for costs, third-party discovery, etc.; representing client in a complex shareholders’ dispute leading to over 20 actions in Hong Kong and overseas

• Contentious Probate: advising on the relevant principles and procedures on contentious probate including caveat procedures and executor/administrator ‘passing over’ applications; representing executrix and beneficiaries in a disputed will all the way to trial in a case involving principles of testamentary capacity, animus testandi and fraudulent calumny, resulting in overwhelming victory

• Insolvency: vast experience in advising clients on statutory demands, petitions and dealing with bankruptcy / winding-up procedures and hearings; successfully obtaining order in favour of client in an application to set aside a statutory demand on an alleged loan of over HK$10 million

• Trust and Estate Planning: representing a HNWI in his family trust including drafting of letters of wishes, drafting of documents effecting injection into trust and communicating with professional trustee

Outside of contentious work, Theresa also regularly advises clients on non-contentious matters including non-contentious applications for probate and letters of administration, preparation of wills, preparation of powers of attorney or enduring powers of attorney and conveyancing.
